Resigned his seat to become minister to Spain, during which time he co-authored the "Ostend manifesto," which advocated the annexation of Cuba. Arrested by Union forces in New Orleans and imprisoned at Fort Lafayette, New York, for several months in 1862. Later joined General Beauregard's staff in Charleston, South Carolina, as an honorary member. Commissioned as a brigadier general to raise a foreign legion, but no such forces were ever assembled.
