He was breveted a colonel four days before Lee's surrender. After the war, Ochiltree returned to Texas and served one term in Congress (1883-1885). Following his retirement from Congress, he moved to New York. He died in Hot Springs, Virginia on November 25, 1902, and is buried in New York.
