Resigned his U.S. Army commission in January 1861 and was commissioned as a colonel in the 10th Alabama Infantry in June 1861. Promoted to brigadier general in March 1862 and major general in October 1862. Major campaigns and battles include First Manassas, Dranesville (wounded), and Vicksburg (captured). Following Vicksburg he served the rest of the war in the Trans-Mississippi. After the war, Forney returned to Alabama. He died in Jacksonville, Alabama, in September 1902 and is buried there.
