Summary:Kilpatrick had been charged with the murder of Boaz police chief Leonard J. Floyd, who had been killed in a shoot-out on May 17; Upton and Fred Goble were also charged in connection with the event, during which three other men (Sheriff E. M. Boyes, Chief Deputy Washington Bennett, and Kilpatrick's father, Aubrey) were also killed. This image was published in the Birmingham News on July 23, 1951, with the following caption: "On trial at Albertville - Standing trial this week on a charge of slaying of three law enforcement officers last May are Tom Upton, at left; James Kilpatrick, center, and Fred Gable, right, all of Boaz.
