A similar photograph was published on page 11 of the Birmingham News on March 10, 1939, with the following caption: "All Over a Dog - The legality of Birmingham's dog ordinance which requires the annual inoculation of dogs at a fee of $1 has been carried to the U.S. Supreme Court for final decision by the Dog Owners Protective Alliance of Birmingham, of which Mrs. Mabel Jones West, shown above with dog 'Mitzi,' is president. Judge J. Fritz Thompson granted an injunction restraining the city, but the State Supreme Court, on appeal by the city, held the ordinance was constitutional. The case has been placed on the U.S. Supreme Court dockets for action in April." Ultimately, the Supreme Court declined to intervene.
